Tesla chief Elon Musk renewed his criticism of OpenAI, arguing that the company’s commercial direction has compromised safety, according to a newly released transcript of his September 2025 video deposition. The testimony was disclosed ahead of Musk’s April jury trial in his 2024 lawsuit accusing OpenAI of abandoning its non-profit origins.
Musk claimed that OpenAI’s chatbot ChatGPT has been linked to multiple lawsuits alleging that manipulative conversations contributed to negative mental health outcomes, including suicides. “Nobody has committed suicide because of Grok, but apparently they have because of ChatGPT,” he said in the deposition.
Musk questions OpenAI’s safety posture
Musk argued that OpenAI’s partnerships emphasise “speed, scale, and revenue” over user protection. He said he signed a 2023 public letter calling for a pause on the development of AI systems beyond GPT-4 because “it seemed like a good idea” and that he wanted “AI safety to be prioritised.”
He also acknowledged being “mistaken” about previously suggesting he had donated $100 million to OpenAI, with filings placing the figure at about $44.8 million. Musk added that artificial general intelligence “has a risk” if not managed properly.
The deposition is expected to play a central role in Musk’s case as both sides prepare for trial.
Even as Musk contrasted OpenAI’s record with that of his own AI company, xAI, the firm has been under investigation. In January 2026, social media platform X was flooded with non-consensual nude images created by xAI’s Grok model, including images allegedly involving minors. The incident prompted probes by the California Attorney General and European Union regulators, with some governments moving to ban the chatbot.
Separately, a federal judge in California has dismissed xAI’s lawsuit against OpenAI, Reuters reported. The complaint, filed in September 2025, alleged that former xAI employees who joined OpenAI took Grok-related source code and confidential material.
US District Judge Rita Lin ruled that xAI did not present facts to show misconduct by OpenAI. “Notably absent are allegations about the conduct of OpenAI itself,” the order stated. Lin added that while xAI may have claims against individual ex-employees, it “does not state a plausible misappropriation claim against OpenAI.” The dismissal was issued with permission to refile.
