A federal judge has dismissed a lawsuit filed by Elon Musk’s AI venture, xAI, against Sam Altman’s OpenAI. The suit accused OpenAI of misappropriating trade secrets related to chatbots.
Judge Rita Lin ruled that there was no evidence to support the claims that OpenAI had induced a former xAI engineer to leak confidential information, or that OpenAI engineers were aware of any wrongdoing. The case, originally filed last September, focused on alleged misappropriation of information by former xAI employees now at OpenAI.
The decision marks Musk’s second legal defeat against OpenAI in four weeks. A prior ruling went against Musk’s $150 billion lawsuit involving OpenAI’s transition from nonprofit origins to a for-profit model. xAI is a division within Musk’s SpaceX enterprise. Neither xAI nor OpenAI provided immediate comments following the ruling.
