New York is leading the charge in regulating surveillance pricing, as experts don’t expect federal action anytime soon.
“[The] action serves as a reminder to online marketplaces that violating the INFORM Act can result in serious consequences, including civil penalties,” said Christopher Mufarrige, director of the Federal Trade Commission’s Bureau of Consumer Protection.
“With the potential for both state and federal action on priorities that may or may not align, companies must navigate an evolving enforcement map, in which the path may run through Washington, D.C., state capitals, or both,” Morgan Lewis attorneys wrote in a note to clients.
“If you had been updating your subscription model in anticipation of the click-to-cancel rule, your best course of action is to complete the play,” Nelson Mullins Riley & Scarborough wrote in a note to clients.
The INFORM Consumers Act, which when into effect June 2023, requires online marketplaces like eBay and Amazon to verify the identities of high-volume third-party retailers who use their services.
