TALLAHASSEE, Fla. (WCTV/Gray Florida Capital Bureau) – Florida’s attorney general is proposing a new law that would allow AI chatbots to be suspended in Florida if they are found criminally liable in a case.
Attorney General James Uthmeier says the Florida Board of Medicine is going to investigate these AI companies to see if their chatbots are practicing medicine without a license.
He also wants lawmakers to give the state the power to crackdown on chatbots.
Uthmeier is investigating ChatGPT for its role in the FSU shooting. He said on Tuesday more subpoenas would go out in the next two weeks.
But, he also wants the legislature to regulate the AI chatbots further.
“AI is not a person, no, but it is marketed as exhibiting human behaviors,” Uthmeier said. “Florida laws will judge them by their words and their actions.”
The AG says his proposal is not a ban.
“We have got to compete with China. They would love nothing more than to slow us down and to get out ahead of us. And, if they beat us on AI, we are toast,” Uthmeier said.
Melissa Sims, a Collier County woman, says she was arrested for violating a no-contact order.
But, the text message being used against her was fabricated with the use of AI. The charges were dropped, but she had to fight the case for eight months.
“They can use digital, they can use AI, they can create a screenshot of a text, they can create medical records. They can create pandemonium,” Sims said.
In addition, Uthemeier’s proposal would allow the owners of chatbots to be criminally or civilly liable if they don’t fix loopholes or if they contribute to a crime.
A company hosting the chatbot could face fines, payments to victims or in some cases, be suspended from operating in Florida.
These ideas from the attorney general have not been passed into law.
