The family of a 12-year-old girl injured in a deadly school shooting in Canada has filed a civil lawsuit against OpenAI, alleging the company failed to notify authorities despite warning signs linked to the attacker’s interactions with ChatGPT.
The case stems from the mass shooting that occurred on February 10 in Tumbler Ridge, located in British Columbia. The incident left eight people dead and several others injured, making it one of the deadliest school shootings in Canadian history.
Among the injured was 12-year-old Maya Gebala, who sustained gunshot wounds to the head and neck and remains hospitalised.
Lawsuit filed by victim’s mother
The legal complaint was filed by Maya’s mother, Cia Edmonds, who argues that OpenAI should have taken stronger action after identifying concerning conversations between the suspect and the chatbot.
According to the lawsuit, the alleged attacker—identified as Jesse Van Rootselaar, an 18-year-old—used ChatGPT in the months leading up to the attack and discussed various scenarios involving gun violence.
The complaint states that the suspect allegedly treated the chatbot as a “trusted confidante,” using it to explore violent ideas over several days during late spring or early summer of 2025.

Account banned but authorities allegedly not notified
The lawsuit claims that an initial ChatGPT account connected to the suspect was banned by OpenAI in June 2025 because of the nature of the conversations.
However, the plaintiffs allege that the company did not inform Canadian law enforcement authorities about the potentially concerning interactions.
According to the filing, some OpenAI staff members reportedly flagged the conversations internally as possible indicators of a serious threat and suggested contacting authorities. The complaint alleges that the recommendation was ultimately rejected and that suspending the account was the only step taken.
Second account allegedly created
The lawsuit also claims the suspect was able to create another ChatGPT account after the first one was banned.
This, the plaintiffs argue, allowed additional conversations involving violent scenarios to continue, despite what they describe as warning signs suggesting potential long-term planning of a violent attack.

The case raises broader questions about the responsibilities of AI companies when users discuss potentially harmful or violent topics with conversational systems.
