A federal judge in California has dismissed a lawsuit filed by Elon Musk’s artificial intelligence startup xAI that accused rival OpenAI of stealing trade secrets related to its Grok chatbot.
U.S. District Judge Rita Lin, presiding in San Francisco, ruled that xAI had not sufficiently alleged wrongdoing by OpenAI itself. However, she granted the company permission to amend and refile its complaint by March 17.
Court Finds No Direct Allegations Against OpenAI
The lawsuit, originally filed in September, claimed that former xAI employees had taken proprietary source code and confidential information when they left to join OpenAI. But Judge Lin noted that the complaint lacked specific claims that OpenAI induced the alleged theft or knowingly used any misappropriated trade secrets.

In her ruling, she pointed out that xAI did not present facts indicating that OpenAI encouraged former employees to take proprietary material or that such material was used after they were hired.
The judge had earlier indicated in a January opinion that she was inclined to side with OpenAI.
Broader Legal Battle
The trade-secrets dispute is one part of a larger legal confrontation between Musk and OpenAI, which he co-founded before later parting ways with the company. Musk has separately sued OpenAI and its key backer Microsoft over its transition to a for-profit structure, seeking damages that could reach as high as $134.5 billion. Jury selection in that case is scheduled for April 27.
OpenAI welcomed the dismissal, calling the lawsuit baseless and characterising it as another attempt by Musk to target a competitor.

In court filings, OpenAI argued that the trade-secrets case formed part of what it described as a broader campaign of unfounded legal action, suggesting that xAI’s Grok chatbot was struggling to compete with ChatGPT.
Separate Case Against Former Engineer
xAI has also filed a separate lawsuit against a former engineer, Xuechen Li, alleging that trade secrets were taken when the employee departed for OpenAI. That case remains ongoing.
The latest ruling adds another chapter to the escalating rivalry between Musk’s AI ventures and OpenAI, underscoring intensifying competition and legal friction within the fast-growing artificial intelligence sector.
