Today, America First Legal (AFL) sent a letter to Senate Judiciary Committee Chairman Charles Grassley and House Judiciary Committee Chairman Jim Jordan demanding they investigate a collusive arrangement between Apple Inc. and OpenAI. This arrangement integrated ChatGPT as the sole generative AI chatbot accessible through Siri and other core iPhone features — denying Americans meaningful choice and exposing them to a single, systematically biased AI voice that could twist American minds like no technology before.
Unlike ordinary consumer products or services, generative AI is uniquely positioned to — and, as AFL shows, does — shape the minds, worldviews, and political judgments of individual Americans in ways never before possible. As AI becomes the dominant medium through which millions access information, summarize news, draft communications, and form opinions on public affairs, the Apple-OpenAI deal effectively funnels hundreds of millions of iPhone users into one ideologically slanted chatbot.
The potential for one ideologically slanted AI platform to dominate daily life for the American people is a direct threat to the free speech, free inquiry, and diversity of viewpoints essential to American liberty. Non-governmental actors wielding this kind of technological power can suppress competing perspectives far more effectively than traditional censorship ever could.
Apple controls nearly 70 percent of the U.S. smartphone market, while OpenAI dominates over 80 percent of the generative AI chatbot market. By granting ChatGPT exclusive, seamless integration — and denying competitors equivalent access — the companies have locked rivals out of billions of user interactions critical to AI development. The result appears not only anticompetitive under Sections 1 and 2 of the Sherman Antitrust Act, but also a profound harm to genuine discourse in the United States. Peer-reviewed studies confirm that ChatGPT exhibits strong left-leaning bias: it consistently favors progressive viewpoints on political and social issues, refuses to generate content that represents mainstream conservative perspectives, and can measurably shift users’ political opinions after even brief interactions.
“Biased AI, particularly those AI products baked into consumer products with market dominance, has the potential to exercise unprecedented power over how Americans think and engage with the world,” said AFL President Gene Hamilton. “By colluding to make a single left-biased AI chatbot the default experience for the vast majority of smartphone users, Apple and OpenAI are not just violating antitrust principles — they are endangering free speech itself. Congress must investigate this arrangement immediately to protect competition, viewpoint diversity, and the free marketplace of ideas.”
